1. Scope

These Terms govern access to and use of the nexusdynamics.it website (“the website”), published by Nexus Dynamics Service — an entrepreneurial project in the process of being incorporated.

By browsing the website or using its contact forms you accept these conditions. If you do not wish to accept them, please do not use the website.

These Terms concern the use of the website only. They are not general terms of supply, a service or maintenance contract or a software licence, and they do not govern deliverables, timescales or warranties: those are set out in the contractual documents applicable to each individual relationship.

2. Information published on the website

The content of the website is informative and descriptive: it presents the activities, capabilities and services of Nexus Dynamics Service.

The information published is not an offer to the public, a contractual proposal, a quotation, a commitment to supply or tailored technical advice, and it does not replace professional assessment of the specific case.

Content is maintained with reasonable care but may be changed at any time, and may contain inaccuracies or lag behind how the services evolve.

3. Service and contact requests

The forms and the addresses published on the website may be used to send service, information or contact requests. Submitting a request does not constitute acceptance of the work and does not conclude a contract: every request is subject to a technical feasibility assessment and to confirmation.

The automatic acknowledgement sent by email only confirms that the request was received: it does not commit us to performing any work.

Response times, working arrangements and conditions are agreed case by case and cannot be inferred from the website.

The forms must not be used for urgent communications relating to patient safety, nor to transmit diagnostic images, identifying data or health information relating to patients.

4. Quotations, offers and contracts

Any supply relationship is governed solely by the documents that formalise it: quotation, offer, order, contract proposal or contract signed by the parties.

Where what is published on the website differs from those documents, the applicable contractual document prevails.

The website publishes no prices, rate cards, commercial conditions or discounts: economic terms are defined in the specific offer.

5. Information about services and service plans

The pages describing technical service and service plans — including the plans identified as Only PMS, Only Labor Basic, Only Labor Standard, Only Labor Plus, Full Risk Essential, Full Risk Advanced and Full Risk Premium — are for information only and are intended to guide the enquiry.

Cover, exclusions, included work, duration, start date, limits, liability and economic conditions are those set out in the proposal, offer or contract applicable to each customer, and cannot be inferred from the published description.

Plan names identify a service range: they do not exhaustively describe the scope of the work and are not a guarantee that any specific component, fault or event is covered.

6. Software and digital solutions

The pages devoted to software solutions describe tools under development. The features, interfaces, requirements and availability shown indicate the direction of the project and may change: they are not a release commitment, an availability date or a guarantee of operation.

Any use of those tools will be governed by their own licence or service conditions, provided when they are made available.

7. Intellectual property

The content of the website — text, images, graphics, illustrations, animations, layout, code, documentation and distinctive signs — is protected by applicable intellectual and industrial property law and belongs to Nexus Dynamics Service or to the respective owners.

Reproduction, distribution, modification, publication or reuse of the content, in whole or in part, is not permitted without written authorisation, except for uses allowed by law, including quotation and personal non-commercial use.

Third-party trademarks, names and logos that may be mentioned belong to their respective owners and are used solely for descriptive purposes, to identify the technologies or equipment covered by the services: such references imply no affiliation with, authorisation from or sponsorship by the relevant manufacturers.

8. Website availability

The website is kept running with reasonable diligence, but it is provided “as is”: continuous, uninterrupted availability is not guaranteed.

Access may be suspended or restricted, including without notice, for maintenance, updates, technical or security reasons. Some functions, such as form submission, may be temporarily unavailable: the published email addresses remain available in that case.

The content, structure and functions of the website may be changed, suspended or removed at any time.

9. Links and third-party services

The website may contain links to sites or resources operated by third parties, provided purely for convenience.

Nexus Dynamics Service does not control those resources and is not responsible for their content, their availability or the data processing carried out there: you access them at your own responsibility and under the terms and notices of the destination site.

10. Limitations of liability relating to the website

To the extent permitted by law, Nexus Dynamics Service is not liable for damage arising from the use of or inability to use the website, from service interruptions, or from reliance on published information that has not been confirmed in writing within a specific relationship.

The technical information published is not a fault diagnosis, an operating instruction for intervention, a guarantee of results or a guaranteed service level and must not be used as the basis for work on medical equipment: every intervention requires assessment by qualified technical personnel on the specific system.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Acceptable use

The website may only be used for lawful purposes. In particular, you must not:

• attempt to access restricted areas, accounts or systems without authorisation;
• run scans, intrusion tests or any activity that compromises the security, integrity or availability of the service;
• send unlawful, offensive or misleading content, or unsolicited commercial messages, through the forms;
• extract content on a large scale or use it to build competing databases or services;
• reproduce the website, its distinctive signs or its communications in a way likely to create confusion as to their origin.

For security purposes, anomalous access may be detected, rate-limited or temporarily blocked, with the recording described in the Cookie policy and the Privacy policy.
